Recent legal developments are challenging German planning law: Following the amendment of the RE Directive by Directive (EU) 2023/2413 (known as “RED III”), member states are obliged to designate so-called “acceleration areas”, where RE projects are privileged through a special, accelerated approval procedure. IIn addition, the multiple use of land — for example, for wind and solar plants — is to be promoted to protect the environment. In Germany, amendments to the Wind Energy Area Requirements Act, the Building Code, the Spatial Planning Act and the Federal Immission Control Act are planned. Legal questions regarding their compatibility with wind energy area planning and EU law have been raised; the future challenges for planning practice will also be discussed.
